Mandatory indemnity to practise

From July 2014, all registered health professionals have been required to hold appropriate indemnity to practise as a condition of their registration with the Health and Care Professions Council (HCPC).

This requirement is to ensure that if a patient is harmed due to clinical negligence, the patient will be able to recover any compensation to which they may be entitled.

From April 2016, the HCPC will require new and renewing registrants to sign a declaration that they have appropriate professional indemnity cover in place for their work. Failure to have appropriate indemnity in place may result in the HCPC taking fitness to practice action against a registrant.

The HCPC provides guidance on its indemnity requirements for registrants. Indemnity can be provided by an employer, a professional body or other insurance provider. The HCPC has confirmed that it may conduct checks on an individual’s indemnity to practice if it has reason to believe a registrant is practising without appropriate indemnity, or that a registrant holds cover which is grossly disproportionate to the risks involved in their practice. The HCPC anticipates these circumstances might only arise when working independently and/or privately, or when working in known high risk settings.

The CSP PLI scheme provides eligible members with appropriate levels of cover for medical malpractice and professional indemnity to meet the mandatory requirements, subject to the terms and conditions of the policy.

The CSP PLI scheme does not provide cover for the treatment of certain professional footballers. Members working with excluded footballers should ensure that their employer, or the Football Club with regard to itinerant (self-employed) football physiotherapists, provides the necessary indemnity. If an employer refuses to confirm the extent of their indemnity provision for their workers, then the registrant should be aware that there must be some doubt as to whether adequate provision is in place.
